National Safety Group Limited, trading as National Safety Academy (“National Safety Academy,” “we,” “us,” “our”), is a private limited company registered in England and Wales with company number 15882393. 


National Safety Group Ltd is an Introducer Appointed Representative of Affirm U.K. Limited which is authorised and regulated by the Financial Conduct Authority (Firm Reference Number: 1043144). Affirm U.K. Limited provides consumer credit products and is authorised and regulated by the Financial Conduct Authority (“FCA”) for carrying out regulated consumer credit activities (firm reference number 756087). Company number 10199101, with its registered Office at C/O TMF Group, 1 Angel Court, 13th Floor, London, EC2R 7HJ. Affirm is the trading name of Affirm U.K. Limited.

Our Service


National Safety Academy provides education and training programmes, including learning materials, assessment services, and (where applicable) certification, delivered through a combination of online learning, digital resources, and tutor support.


National Safety Academy may update, amend, replace, or withdraw elements of its Courses, Materials, assessment methods, or delivery models from time to time in order to maintain quality, comply with regulatory or awarding requirements, or improve learner outcomes. Such changes will not materially reduce the overall learning objectives of the Course.


Our Contract With You


All purchases made via the Website, over the phone, or via email are subject to these terms and conditions (the “Terms and Conditions”). Please make sure that you have read and understood these Terms and Conditions before continuing with your booking. 


A legally binding contract between you (or the person or entity booking the Course on your behalf) and National Safety Academy in relation to that booking shall only come into force when:  

  • we have received a booking for you to attend a Course; and
  • we have confirmed our acceptance of that booking to you (or the person or entity booking the Course on your behalf) in writing. 


By agreeing to these Terms and Conditions, you also agree to all National Safety Academy Academic Policies. 

These Terms, including the wording of any Academic Policies, constitute the entire agreement between you and National Safety Academy.

National Safety Academy reserves the right to refuse Applications on any grounds. 

Where a Course is booked or paid for by a third party (including an employer, training provider, or family member), the Learner remains bound by these Terms and Conditions and the Academic Policies. The third party does not acquire any learner rights by virtue of making payment.

Changes to these Terms and Conditions

We reserve the right to amend these Terms and Conditions and our Academic Policies from time to time. The amended terms and/or policies will be effective from the date they are posted on our website.


Where use of the Service has already commenced and we anticipate that a change to a term may materially affect your use of our Service, we will endeavour to notify you of the change as soon as reasonably possible.


Definitions and Interpretation


The following terms are used throughout these Terms and Conditions:


“Academic Policies”: These policies include but are not limited to Academic Malpractice, Resubmission and Late Submission, Re-marking and Complaints. A full list of Academic Policies can be found at www.nationalsafetyacademy.co.uk/policies


“Additional Fees”: This includes any fee incurred which is not a Course fee. Including but not limited to resubmission fees, late submission fees and re-enrolment fees.


“Application”: Purchase of a National Safety Academy Course.


“Community”: Groups of Learners connected in a virtual forum or in-person event facilitated by the National Safety Academy. 


“Course”: The training course or qualification provided by National Safety Academy, as described on our Website.


“Enrolment”: An accepted Application for a National Safety Academy Course.


“Learner”: An individual enrolled on a National Safety Academy Course.


“Materials”: Any study, course, learning, or assessment resources provided in hard copy, electronically, via the online portal, audio, or video.


“Online Learning Portal”: The platform hosted on our Website where Learners access course materials and submit assessments.


"Payment Plan": An agreement between the learner and National Safety Academy or a third-party payment provider for the sum of the course fees to be paid in instalments. 


“Website”: Our website, www.nationalsafetyacademy.co.uk


Courses


Full details of our Courses and applicable fees are available on the Website.


While we strive to keep information accurate, we do not guarantee that the Website or printed marketing materials will be error-free or fully up-to-date. Learners are encouraged to verify information independently and contact us with any queries.


It is your responsibility to ensure the Course is suitable for your needs, including your English proficiency.


National Safety Academy does not guarantee any specific outcomes from completing the Course or using the materials. Specifically, National Safety Academy does not guarantee that completion of a Course will result in a particular qualification outcome, level of competence, professional recognition, employment, promotion, regulatory approval, or career opportunity.


National Safety Academy reserves the right to amend or update materials without prior notice.


Fees and Payment


Course fees (excluding VAT) are listed on the Website and are correct at the time of publication. Enterprise fees are agreed on a case-by-case basis.


From time to time, National Safety Academy may offer promotional discounts on Course fees. Unless otherwise explicitly agreed in writing, only one promotional offer may be used per Enrolment. National Safety Academy reserves the right to cancel and refund any Enrolments which are made using more than one promotional offer where this has not been previously agreed. 


National Safety Academy reserves the right to change fees before accepting your Enrolment.


Additional Fees are not guaranteed to remain at the same rate as the date of your Enrolment. If you are required to pay an Additional Fee, it will be payable at the amount quoted on the day it is incurred.


Unless a Payment Plan is successfully agreed with National Safety Academy or a third-party provider at the point of purchase, full payment is required before login details and materials are issued. Payment methods include debit/credit card or BACS transfer.


If a third party (e.g., an employer or family member) is paying the fees on behalf of the Learner, invoices must be paid within 14 days. If unpaid after this period, the invoice expires, and a new one must be requested.


Payment Plans


National Safety Academy may make Payment Plans available from time to time.


These may be in the form of:

1. An interest-free payment plan offered directly by National Safety Academy; or

2. A payment plan offered by a third-party provider which the Learner is introduced to via National Safety Academy.


National Safety Academy reserves the right to decide which products and services payment plans are available for and the right to withdraw the offer of payment plans at any time without notice.


You are responsible for ensuring that your payment method has sufficient funds and is up to date. Failure to resolve a missed payment within 3 days may result in suspension or cancellation of the Plan. 


Where a Learner is suspended or excluded from a Course for a finding of misconduct, malpractice or otherwise, the payment plan will remain unaffected and the Learner will still be liable to pay the balance in full during the suspension or following the exclusion.


Where a payment plan is offered directly by National Safety Academy, additional terms apply as follows:

1. You will not be entitled to receive a Certificate confirming successful completion of the course until your balance has been paid in full. 

2. We reserve the right to pursue collection of the outstanding Balance, including engaging third-party collection agencies.

3. By selecting the Plan, you acknowledge that you have read, understood, and agree to these terms and conditions.


If selecting a payment plan offered by a third-party provider, please ensure you have read and agreed to their terms before entering into the finance agreement.


Cancellations 


You have the right to cancel an unused Enrolment within 14 days by notifying us in writing. You do not have to give a reason.


Upon requesting a summative assessment, the Enrolment will be deemed ‘used’ and the right to cancel and receive a refund will be forfeited.


Upon valid cancellation, the original payer will be issued a full refund of the Course fee using the original payment method.


For the avoidance of doubt, no partial refund or discount will be issued for any Course elements that are not taken up.


Exclusions


National Safety Academy reserves the right to exclude learners in the following circumstances:

- where the Learner demonstrates an inability or unwillingness to meaningfully engage with, or to comply with, National Safety Academy’s Academic Policies;

- where National Safety Academy reasonably believes the Learner to be enrolled for disingenuous, improper, or non-genuine purposes;

- in the event of misconduct, abuse, harassment, threatening behaviour, or behaviour that disrupts the learning environment or undermines the integrity of the Course or assessments;

- where there is evidence of academic malpractice, plagiarism, collusion, or any attempt to gain an unfair advantage in assessment;

- where the Learner has previously been excluded from, suspended from, or barred from enrolling on any National Safety Academy course or service, and National Safety Academy reasonably determines that re-enrolment is not appropriate.

- where the Learner’s conduct brings, or is likely to bring, National Safety Academy into disrepute.


Where a Learner is excluded from the Course, partial or full refund of any Course or other fees incurred will be at the sole discretion of National Safety Academy.


Assessment Marking and Timescales


All assessment marking timescales, feedback turnaround times, and indicative completion or certification dates are provided for guidance only and do not form part of these Terms and Conditions.


National Safety Academy will use reasonable endeavours to mark assessments and provide feedback within the published or communicated timescales. However, marking may take longer where additional quality assurance, internal verification, external review, or assessment integrity checks are required.


Delays to marking or feedback do not constitute a breach of contract and do not give rise to any entitlement to refunds, fee reductions, compensation, or extensions, unless expressly agreed in writing.


Where a Learner’s work is subject to academic integrity review, suspected malpractice investigation, or referral to third-party assessment integrity tools, marking timescales may be extended without notice.


National Safety Academy reserves the right, at its sole discretion, to restrict or prevent a Learner from progressing to further Course Materials or learning stages until the relevant assessment(s) have been successfully passed.


Duration


Learners must pass the Course within the duration stated on the course page on the date of Enrolment. This will be confirmed in an email following enrolment.


If a Learner does not pass the Course within this duration, they may be subject to Additional Fees to extend the course duration. 


Course extensions are awarded at the discretion of the National Safety Academy.

Where a Learner is suspended from Course due to contravention of an Academic Policy, abuse or misconduct, or for any other reason, the time under suspension will count towards their total duration and the Learner may be subject to the usual Additional Fees where the Course cannot be completed within the specified Duration.


Free courses 


National Safety Academy may, from time to time, offer courses or learning resources at no cost (“Free Courses”) to the public or to specific user groups.


Free Courses are provided on an “as available” basis and may be amended, suspended, or withdrawn at any time without prior notice.


Unless expressly stated otherwise, Free Courses do not include tutor support, summative assessment, or formal certification.


Free Courses are provided for personal, non-commercial use only. National Safety Academy reserves the right to restrict, suspend, or terminate access to Free Courses where it reasonably believes there has been misuse, abuse, or a breach of these Terms and Conditions.


National Safety Academy may limit access to Free Courses, close user accounts, or delete associated data at any time, without liability, particularly where continued access is no longer appropriate or consistent with the intended purpose of the Free Course.


Abuse and Misconduct


National Safety Academy has a zero-tolerance policy for abusive behaviour.


Allegations of abuse or misconduct will be investigated. During this process, we may suspend your Enrolment (e.g. Course access).


If abuse or misconduct is confirmed, National Safety Academy reserves the right to terminate services immediately without issue of a refund.


Special attention is drawn to misconduct which amounts to academic malpractice as defined in our Academic Policies. National Safety Academy reserves the right to suspend the Enrolment of any Learner suspected of malpractice or plagiarism.


Data Protection


If an Enrolment has been paid for by a third-party (i.e. an employer or family member), the Learner hereby agrees for information on their course progress to be shared. This may include assessment results, activity logs or other relevant information.


In order to maintain the integrity, quality, and fairness of its assessment processes, National Safety Academy may review learner work using manual checks and may share learner submissions, assessment data, or related information with third-party service providers for the purposes of assessment marking, quality assurance, academic integrity review, and the detection of plagiarism, collusion, or the use of artificial intelligence or other unauthorised assistance. By submitting work for assessment, the Learner consents to such processing and sharing of data strictly for these purposes.

Intellectual Property


You acknowledge that all intellectual property rights (including, but not limited to, copyright, trade marks, rights in designs and goodwill) in the Courses, study or assessment materials or any other learning materials made available in connection with a Course belong and shall belong to National Safety Academy (or its licensor).  


National Safety Academy grants to you a non-transferrable, non-exclusive license to use such study or assessment materials or any other learning materials as may be made available to you in connection with the Course in a personal capacity and in connection only with study by you in relation to that Course, such license to terminate upon your completion of the Course or upon termination of the Course. You are not permitted, without the prior written consent of National Safety Academy, to copy, make available, retransmit, reproduce, sell, license, distribute, publish, broadcast or otherwise circulate such materials.


Usernames and passwords are for your personal use only and must not be provided or passed to any third parties. You are required to protect your login information at all times in order to protect National Safety Academy’s intellectual property rights as detailed.


Limitation of Liability


Nothing in these Terms and Conditions excludes any party’s liability for:  


death or personal injury caused by that party's negligence; or  


fraud or fraudulent misrepresentation. 


The aggregate liability of National Safety Academy to you in contract, tort (including negligence) or otherwise, arising in connection with these Terms and Conditions shall be limited to the total fees paid by you for the particular Course. 


Technical Requirements and Support


It is your responsibility to check that the computer or any other device you plan to use to access any online study materials on the Course is compatible with the relevant minimum specification requirements for using the Website and participating in any live online sessions. 


Your web browser may have active pop-up blockers to suppress unwanted advertising. Similarly, you may be behind a content-blocking device such as a firewall. It may be necessary to reconfigure or disable these.  


National Safety Academy is not responsible for delays outside our control. If provision of a Course is delayed by an event or technical issue outside our control, we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this, we will not be liable for delays caused by the event or issue. 


National Safety Academy will not be responsible to you for any delay or disruptions to your access to material as a result of any of the following: 

- operation of the internet and World Wide Web (including, but not limited to, the effect of viruses); 

- firewall restrictions which may have been placed on your network or the computer you are using to gain access to online study; or 

- the failure of telecommunications links or equipment or browser issues. 


If a technical fault is reported to National Safety Academy, we will use reasonable endeavours to provide a solution but we do not guarantee that the support provided will resolve your technical problems. If technical advice is provided by National Safety Academy, we do not accept any responsibility for any problems which arise if you do not ensure that such advice is followed strictly. Technical support advice is provided at your own risk. 


Periods of downtime may be required in respect of National Safety Academy’s information technology infrastructure (for example, the Website or any other websites used to host online materials). National Safety Academy will not have any liability with respect to any such periods of unavailability. 


We cannot guarantee uninterrupted availability of online learning resources. In particular, National Safety Academy reserves the right to suspend access to the Website or any other online resources for the purpose of scheduled or emergency maintenance, repairs and upgrades or to improve performance and functionality. 


We are not responsible for any problems or the technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment or software, failure of any email or online application to be received on account of technical problems or traffic congestion on the internet, telephone lines or at any website, or any combination of these, including any injury or damage to your or any other person’s computer or mobile telephone related to or resulting from accessing or downloading any materials relating to a Course.
